What are some of the advantages of mediation and a collaborative divorce?

The day that you and your spouse plan to split up is drawing ever closer. You have been looking into your divorce options, and you’re interested in mediation. You want to know what advantages it holds over going to court.

One huge advantage is that you get to make more of the decisions on your own. The goal is to work with the mediator and come to an agreement with your spouse, rather than going to a judge and being told what you have to do. The mediator doesn’t make the decision for you; he or she just helps guide you through the process. Your freedom of choice is still your own.

It’s also a more personal process. You don’t get a judge who doesn’t care about you and who sees a lot of cases every week. You get a mediator who learns what you really want, what you care about the most and what goals you have. You and your spouse then work with the mediator to find an outcome you both approve of.

It can also be faster. If you want, you and your spouse can set your own deadlines. Couples who are splitting up often don’t want to spend months with a lengthy court case. They just want to get it all over with.

Mediation also offer some scheduling flexibility. You’re busy. You have kids, a job and a life. The court just tells you to put everything on hold, but a mediator works with you to find a schedule that fits your life.
